The United States is the only country in the Western world to criminalize the public distribution of information about private citizens. This is not some arcane anomaly of criminal law, but a bedrock principle of liberty. It is said that the individual has a right to be left alone.
This is a cornerstone of the most basic tenets of our republic, and is the basis for a free people. It has been recognized since the early days of the republic, when Thomas Jefferson, in proposing a bill of rights, clearly stated, “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated.”
But since the terrorist attacks of 2001 and their aftermath, this principle has been systematically violated on a scale and with a scope that have rarely been seen in America.
In the aftermath of those attacks, the federal government dramatically increased its spying powers and turned the act of spying on citizens into a full-blown criminal violation with a great number of new criminal statutes on the books.
In total, we now have a nearly limitless array of crimes, including everything from providing the personal information of your phone to anyone other than the state or its designated agents, to various theft and fraud charges.
